Why Urban Transformation?

Our country is located in an earthquake zone, and unfortunately, 90% of buildings are not earthquake-resistant.

In our country, where we have learned many times that earthquake-prone buildings that have completed their physical lifespan cause serious loss of life and property, urban transformation allows you to protect your family and loved ones from earthquakes, acquire new, comfortable, and safer homes, and benefit from the advantages provided by the state. The Urban Transformation Law No. 6306, enacted on May 31, 2012, aims to transform earthquake-prone and risky buildings into earthquake-resistant, modern, and aesthetically pleasing buildings in accordance with current zoning plans, with incentives such as loan support, tax and fee exemptions, and rental assistance provided by the state, upon the request of the property owners.

WHAT IS THE MAIN PURPOSE OF THE URBAN TRANSFORMATION LAW NO. 6306?

The Urban Transformation Law aims to create healthy, safe, and livable environments by transforming areas at risk of disaster and risky buildings.

WHO CAN APPLY?

An application from any of the apartment owners who wish to have their building assessed for risk is sufficient.

HOW DOES THE URBAN TRANSFORMATION PROCESS WORK?

For your building to be included in urban transformation, you must first obtain a "Earthquake Risk Report" from an authorized institution of the Ministry. Once the Ministry approves the earthquake risk report, your building is included in the urban transformation program.

The Ministry sends an informative letter to all apartment owners.

Apartment owners who wish to do so can appeal to the Ministry for a re-examination of the prepared and approved report. If the appeals commission decides that the building is risky, the building must be demolished.

In this case, even a stay of execution order cannot be obtained from the court.

After this stage, within a maximum of 60 days, a decision must be made regarding how, with which contractor, and with what partnership the building will be demolished, and a "Building Joint Decision Protocol" regarding the use of urban transformation loans must be approved by a 2/3 majority.

If the decision cannot be made within 60 days, the building will be demolished by the Ministry.

Subsequently, the preparation of the new building's municipal projects, obtaining a construction permit from the municipality, and obtaining the occupancy permits and title deeds for the new apartments are required.

WHAT ARE THE ADVANTAGES OF THE URBAN TRANSFORMATION LAW?

Property owners can use state-subsidized urban transformation loans and urban transformation rental assistance for building construction.

Tenants can benefit from state-subsidized urban transformation loans and relocation expenses when purchasing new apartments.
